These terms apply to your use of solarfunnel.io (Part A) and, if you subscribe, to your use of the SolarFunnel service (Part B). SolarFunnel is a trading name of Sova Sleep Ltd, a company registered in England and Wales (company number 17277239), registered office 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ ("we", "us").
Part A: Using our website
1. The website and demo
Our website and demo show how SolarFunnel works. Products, prices, savings and other figures in the demo are illustrative examples only. They are not an offer, a quote or advice to any homeowner.
2. Acceptable use
You must not misuse the website, for example by attempting to gain unauthorised access, interfering with its operation, scraping it at scale, or using the demo to extract map or roof data.
3. Intellectual property
We own, or are licensed to use, the content, design and software on our website. You may view it for your own business purposes, but must not copy or reuse it without our permission. Map imagery and roof data are provided by Google and are subject to Google's terms.
4. Liability
We provide the website "as is" and do not guarantee it will always be available or error-free. Nothing in these terms limits liability that cannot be limited by law.
Part B: SolarFunnel subscriptions
Part B applies to businesses that subscribe to SolarFunnel ("you", "the client"). SolarFunnel is provided for business use only. Any order form or proposal we agree with you forms part of these terms, and takes priority where it says something different.
5. The service
SolarFunnel provides a branded instant-quote tool for your website and ads, roof and sunlight estimates using third-party data, lead alerts, survey booking, automatic follow-up messages and the related setup and support described on our pricing page or in your order. We may improve or change features over time, without materially reducing the core service you pay for.
6. Fees and payment
- The one-off setup fee is payable before we start building your funnel. Once setup work has begun it is non-refundable.
- Subscription fees are payable in advance, monthly or annually, as shown on our pricing page or in your order.
- Prices exclude VAT and other taxes, which are added where applicable.
- If payment is late we may suspend the service after giving you notice.
- We may change our prices by giving you at least 30 days' notice. Annual plans keep their price until renewal.
7. Term and cancellation
- Monthly plans have a minimum term of 3 months, then continue month to month. You can cancel by giving at least 30 days' notice, ending after the minimum term.
- Annual plans run for 12 months and renew for a further 12 months unless either of us gives at least 30 days' notice before renewal. Annual fees are non-refundable.
- Either of us may end the agreement straight away if the other seriously breaches these terms and doesn't fix the breach within 14 days of being asked to, or becomes insolvent.
8. Your responsibilities
- Your prices, products and wording are accurate and kept up to date. You're responsible for the prices and claims shown to homeowners on your funnel.
- Estimates shown to homeowners are indicative. You'll confirm designs and prices after a survey, and comply with the consumer protection, advertising and industry rules that apply to you, including any certification scheme (such as MCS in the UK) and any rules on promoting finance.
- You have a lawful basis to contact homeowners who use your funnel, including any consent needed for marketing calls, texts or emails under the laws that apply to you (such as PECR in the UK or the TCPA in the US). You approve the follow-up messages sent in your name.
- You keep your login details secure, and use the service lawfully.
9. Data protection
For homeowner data collected through your funnel, you are the controller and we are your processor. We will: process it only on your documented instructions; keep it confidential and secure; use only sub-processors who are bound by equivalent obligations (including Netlify and Google), and tell you before adding new ones; help you respond to individuals' requests and to meet your security and breach-notification obligations; notify you without undue delay of a personal data breach; and delete or return the data when the service ends, unless the law requires us to keep it. Our privacy policy explains how we handle our own data.
10. Third-party data and estimates
Roof, imagery, sunlight and map data come from third parties such as Google. We don't guarantee this data is complete or accurate for every property, and estimates are not a substitute for a survey.
11. Intellectual property
We own the SolarFunnel platform and software. You own your branding, content and data. You give us permission to use them to provide the service. If you give us feedback, we may use it to improve SolarFunnel.
12. Availability and support
We aim to keep SolarFunnel available at all times and to fix problems promptly, but can't guarantee uninterrupted service, for example during maintenance or outages at our providers.
13. Ads management add-on
If you take our optional ads management, its fee and scope are set out in your order. Ad spend is paid by you directly to the ad platforms, and you own your ad accounts. We'll work to improve results, but can't guarantee a particular number of leads, surveys or sales.
14. Liability
Neither of us is liable to the other for indirect or consequential loss, or for loss of profit, revenue or business. Our total liability to you in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
15. General
We may update these terms by giving you at least 30 days' notice of material changes. Neither of us may transfer the agreement without the other's consent, except that we may transfer it as part of a business sale or reorganisation. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
